How it works with probate

Do all the heirs have to agree?

The person with legal authority (usually the court-appointed personal representative) signs. In practice it goes smoother when the heirs are on the same page; your probate attorney will tell you what consent or court approval your estate needs.

Can we sell before probate is opened?

You can talk to us and get an offer before anything is filed. Closing needs someone with authority to sign, which usually means a probate case (or a summary administration) has to be opened first.

There are back taxes on the house. Is that a problem?

Usually not. Back taxes are paid from the sale proceeds at closing. If a tax deed sale is scheduled, call right away — timing matters.

The house is full of my parent’s things.
