Before you decide: four facts that change the math

  1. Removing damaged materials usually doesn’t need a permit; repairs do. St. Pete says tear-out of drywall, flooring and cabinets needs no permit, but replacing them does — and unpermitted repairs become a code violation.
  2. The value can be challenged. Pinellas County offers a free pre-storm building value reconsideration through the Property Appraiser, or a professional appraisal; both cities and counties accept a qualifying appraisal.
  3. A code case doesn’t block a sale. In St. Pete’s words: “An active codes case does not prevent a property sale.”
  4. Insurance may help. Flood policies can include Increased Cost of Compliance coverage, and FEMA and SBA programs exist — ask your insurer before you decide.

What is the 49% rule in St. Petersburg?

In St. Petersburg’s flood hazard area, repairs or improvements that together cost 49% or more of the structure’s pre-damage market value make it substantially damaged, so the whole building must be brought into compliance with current flood rules, which can mean elevating it. The City uses the Property Appraiser’s structure value or a qualifying independent appraisal.

Is Hillsborough County’s rule 49% or 50%?

Hillsborough County uses 50%: a building is substantially damaged when restoring it would cost 50% or more of its market value before the damage, from any cause. St. Petersburg and unincorporated Pinellas County use 49%.

Can I sell a house that got a substantial damage letter?

Yes. The letter limits what can be repaired without meeting current flood rules; it doesn’t stop a sale. St. Petersburg states that an active codes case does not prevent a property sale. A buyer purchasing as-is takes on the repair, elevation or rebuild decision.

Does the rule apply to fire damage?

Yes, in a flood hazard area. Hillsborough’s rule covers damage of any origin, and St. Petersburg’s applies to all repairs even if the damage was not caused by flooding.
